General Legal Framework Japan's constitution founded on democratic principles was promulgated on 3 November 1. May 1. 94. 7. It is considered the supreme law of the nation and the Emperor as well as the legislative, executive and judicialpowers must respect and uphold it (Art. Constitution). According to this constitution, the Emperor has only a sybolic and formal function. The constitution also establishes the separation of powers and the fundamental human rights. The legislative power is vested in the Diet (KOKKAI), which consists of two houses, the House of Councillors (Sangiin) and the House of Representatives (Shugiin). As a general rule, a bill becomes a law merely by passing both houses. If a bill has passed the House of Representatives but is defeated in the House of Councillors, it can become law if passed a second time in the House of Representives with two- thirds of all members present. As Japan is divided into prefectures, the membership is largely based on proportional representation from prefectural districts. Only half of the members who belong to the House of Councillor are elected from the nation at large. The members of both houses also have limited terms of office. Members of the House of Councillors are elected to six year terms, and members of the House of Representatives serve four year terms. The House of Representatives may also be dissolved at any time by the government. The executive power is made up of the Cabinet, which is headed by the Prime Minister. It submits bills to the Diet and exercises control over administrative branches. The Prime Minister is designated by the Diet and must, like the majority of the appointed Ministers, be from among the Diet's ranks. The Cabinet's members do not have constitutionally limited terms of office but must resign at the request of the Diet. The Supreme Court (Saiko Saibansho) and a number of inferior courts are vested with the judicial power. All judges are granted complete independence in decision making. The Supreme Court has the rule making power and is considered court of last resort, that determines the constitutionality of any law, order and regulation. It is made up of 1. Cabinet and a Chief Judge. The latter is appointed by the Emperor who must follow the Cabinet's designation. Each of the inferior courts are under the control of the Supreme Court which nominates as well the candidates for the post of judge. Labour Law. Fundamental labour standards are granted in the Constitution. Those are: the right and the obligation to work (Art. Art. 3) andthe freedom of workers' association - the worker's right to organize, to bargain and to act collectively (Art. Concerning individual labour law, it is stipulated that wages, hours, rest and other working conditions be fixed by law (Art. Japanese labour law is established within this constitutional framework. It is elaborated by acts, ordinances, collective agreements and work rules. The Civil Code adopted on 2. April 1. 89. 6 gives a basic definition of employment contracts. Labour laws must additionally meet constitutional demands by setting minimum labour standards. There are three major labour laws, namely: the Labour Standards Law (LSL), the Trade Union Law (TUL) and the Labour Relations Adjustment Law (LRAL). The LSL regulates firstly working conditions and secondly the workplace safety and hygene. The TUL guarantees the worker's right to organize and to bargain collectively, whereas labour management adjustments and means of dispute settlement are specified in the LRAL. The LSL was adopted on 7 April 1. September 1. 99. 8. The TUL was adopted on 1 June 1. November 1. 99. 3. The LRAL was adopted on 2. September 1. 94. 6 and last amended 1. June 1. 98. 8. The acts apply to Japanese employees of the private sector, with the exception of seafarers, and may also include foreign workers possessing a visa with a work permit. Concerning those employees who work in public owned enterprises, only the LSL is applicable. Labour relations of public employees are governed mainly by special provisions according to the relevant category. Labour legislation is often supplemented by ordinances, which are issued by the Ministry of Health, Labour and Welfare (prior to 6 January 2. Ministry of Labour) and the appropriate Labour Relations Commission. The latter body consists of representatives coming equally from the workers' and employers' ranks as well as from the general public. Labour legislation also tends to be rather abstract and therefore often needs to be interpreted by ordinary courts, since there are no special labour courts in Japan, and by the Labour Relations Commission. The second strongest legal norm is the collective agreement, which, in practice, part is, for the most, enterprise based, because it is mainly the enterprise trade union and the respective employer who draw up agreements. Collective agreements affect primarily those workers of the firm who are trade union members. According to custom, they tend to be put in writing only as far as is legally required. Further provisions of the agreement, which must of course be in line with the law, are often simply agreed to verbally. The written part of the agreements might therefore be simple or vague. This fact gives more importance to work rules, which stipulate common working conditions at the enterprise level. Any employer with more than 1. Work rules must not infringe upon the applying collective agreement. Then, they fix the elements of the labour contracts within the company, independently of whether the individual worker is trade union member or not. According to the amended Art. LSL and its Enforcement Ordinance, contractual matters like wages, working hours and working conditions must be put in writing, when the labour contract is concluded. In practice, vague contract provisions are nevertheless preferred by the parties so as to have the contract always in line with the work rules and the collective agreement. Contract of employment. Permanent and fixed term contracts of employment. Japanese employment practice is traditionally founded on lifetime employment. The employee usually remains with one company for his/her entire working life. The employment period is thus not stipulated and the post is assured until mandatory retirement age, which is usually somewhere between 5. Such a regular employee normally does not have special skills when he/she enters but tends to be trained within the company by being rotated between different jobs and departments. Specially skilled workers are often additionally needed or small and medium sized enterprises may, for economic reasons, not entirely ensure lifetime employment. Other workers also may prefer not to stay with one company. Fixed term contracts are therefore permitted under the restriction of Art. LSL. No objective reason for the limitation is necessary, but the legal period of validity must not be extended. In general, labour contracts of a fixed term must not be longer than one year. In some exceptional cases, the maximum period is three years. Such cases are labour contracts with highly skilled or experienced workers who are necessary for either the development of new products or temporary need of the business. The employment of workers who are at least 6. Equal treatment of fixed term and permanent contractors is not legally mandated. Nevertheless, Art. LSL provides for a determination of working conditions by workers and employers on an equal basis. De facto, such determination is strongly influenced by trade unions through collective agreements and work rules, but most of the fixed term contractors are not trade union members and therefore not necessarily covered. Thus, also the unlawful prolongation of the fixed term contract by repeated renewals does not establish an indefinite- term contract as of a regular employee. Probation. Any labour contract may specify a probation period at the beginning of the employment contract. The probation time is not legally limited. Its renewal is also not prohibited by law. That means you’re taking in a lot of empty calories, which is unhealthy and will cause you to gain weight, fast. They also contain a boatload of artificial ingredients (for example, trans fats), which your body can even get addicted to. This means you’re not only engaging in overconsumption, but the foods which you’re consuming will cause you to blow up like a balloon. So, as you can see, cutting out these nasty ingredients will allow you to shed pounds even if you’re eating hearty portions of foods which you enjoy. What Foods, You Might Ask? The Meal Plan. Now, this isn’t a vegetarian or vegan diet so there are plenty of meats which you can enjoy. However, when you’re buying meats, you want to buy ones which are fresh, which haven’t been raised using hormones, and which were naturally raised. Meat & Seafood. That being said, you can enjoy such meats as chicken, pork, beef, bacon, lamb, venison, duck, and more. There are countless recipes you can enjoy with all these meats, and they can make up the better portion of many different breakfasts, lunches, and dinners. Now, on the subject of meats, what about seafood? If you’re someone who loves seafood, then you’re in luck. Vegetables. For fruits, you can eat apples, grapes, oranges, peaches, blueberries, plums, watermelon, raspberries, strawberries, lemons, and more. Overall, the Paleo Diet is a wonderful, non- restrictive diet, and best of all . The Low- Carb Diet (aka Atkins, Keto)A low- carb diet, as the name would imply, lowers the number of carbohydrates you take into your body to a bare minimum. The most famous low- carb diet is the Atkins diet (similar to the very low- carb keto diet, which is not covered in this article). Mostly, you’ll be avoiding foods which contain a lot of sugar, as well as all manner of breads and pastas. One noteworthy thing about low- carb diets is that they’re not very restrictive in terms of how much food you’re allowed to eat. Like the Paleo diet, you can eat healthy portions of food. The low- carb diet is heavily defined by the foods you avoid, so it makes sense to talk about both the foods to avoid, as well as the foods to take in. You’ll want to avoid drinks which are high in sugar, which include candy, cakes, ice cream, soda, and fruit juices. Unlike with the Mediterranean diet (see next), you want to avoid canola oil, as well as various seeds, such as soybean, sunflower seeds, grape seeds, and corn. All these seeds and canola oil have high levels of Omega 6 in common, which is something you want to avoid. You can enjoy a lot of meat with this diet such as beef, pork, chicken, etc. Eating grass- fed is best, and you want to go for ones which are naturally raised, and avoid GMOs, just like with the Paleo diet. You can also enjoy a lot of seafood, such as trout, haddock, salmon, lobster, shrimp, scallops, and crab. Some shellfish, such as oysters and especially mussels, do contain higher levels of carbohydrates, and they should be eaten in moderation, if at all. You can also eat eggs on a low- carb diet, and most people on low- carb diets do indeed consume a lot of eggs. Dairy is OK as well, even high- fat dairy, such as butter, heavy cream, yogurt, and cheese. Aside from that, you can also enjoy just about anything a vegan can enjoy, as far as fruits and vegetables go, but of course, you want to avoid things like pita bread, croutons in salad, a lot of salad dressing, etc. Nuts and seeds are, for the most part, on the menu as well, including walnuts, almonds, sunflower seeds, and pumpkin seeds. You can even enjoy some wine and dark chocolate now and then. That being said, are there any risks to the low- carb diet? Yes, there are some health risks associated with the low- carb diet, including the famous Atkins diet. They’re known for being high in cholesterol, which might increase your chances of heart disease. However, some studies have shown that people who were on the Atkins diet for a long time lowered their bad cholesterol by a fair amount, which is good. You’re also going to be urinating more calcium, which can lead to osteoporosis or kidney stones, which is something you should be aware of. On top of that, some people on low- carb diets have reportedly experienced some kidney issues. Eating a lot of protein does make things difficult for your kidneys, and it might cause issues after a while. The earliest known case of a low- carb dieter was a 6. Mr. Banting was having hearing issues, and Dr. Harvey decided that the issue was because his fat was pressing up against his inner ear. The Mediterranean Diet, as the name would imply, is basedon the Mediterranean cooking style and foods. It’s known for being great for the heart, as well as many other functions of the body. It reduces your chances of getting heart disease by up to 5. It also gives you a lower level of oxidized low- density lipoprotein (LDL) cholesterol, which is the type of cholesterol that’ll clog up your arteries, so you can enjoy clear arteries if you’re on this diet for a relatively long period of time. The Meal Plan. The Mediterranean Diet has its own food pyramid, which is different than the traditional food pyramid which you would’ve learned about in school. As opposed to the bottom of the pyramid being composed of high- carb foods like breads, you instead eat mostly fruits, vegetables, grains, nuts, legumes, and seeds. Being at the bottom of the pyramid, this is the biggest part of the diet. The pyramid has 4 sections in all, each of them stacked on top of each other. This is a list that takes into consideration the different combinations of food and beverage items offered to you this week. Because the program has a lot of flexibility and choices, no one list can be constructed for everyone. In the list below you will find food and beverage opportunities. You can make the choices that fit your preferences and purchase accordingly. Note that there are some items that you must have. You should be sure to buy them so that you will have them on hand when the program calls for them. If you are a vegetarian, you don't need to eat the meat meals. Make appropriate substitutions, but be mindful of calorie counts. This can be a combination of berries and other fruits. Choose your combination from this list. Water is not included; you may have as much as you want. Choose your combinations from the list below. Then purchase your choices for the week. Those opportunities are listed below. You should choose which of these you want, then purchase accordingly. You will have other vegetable opportunities. If you choose them, purchase accordingly. Choose from the list below. But note the maximum number of servings you may have for each option. Make your choices from the list below, mixing them up. Remember, you must have at least 4 servings. For example, you can choose to have 3 pieces of lean beef, 1 piece of chicken, and 1 piece of fish. But you can't have 5 pieces of lean beef. You can have 3 total. Remember, snacks are encouraged, but optional. Each item must be 2. Choose the combination that you desire and purchase accordingly. Choose which of them you want, then purchase accordingly. You can choose all or none of them. You will weigh yourself only once a week, so even if you are tempted, stay off the scale. Your body naturally fluctuates a couple of pounds from day to day. Measuring yourself every day could give you an inaccurate weight and unnecessarily stress you and lead you to believe you're not succeeding. Your next weigh- in will be exactly a week from your initial weigh- in. Make sure you weigh yourself in the same manner each time: if you weighed in wearing certain clothes or no clothes at all, make sure you do the same the second time around and as close to the same time of the day. Make sure you use the same scale both times, as different scales can be off by several pounds, thus destroying the accuracy of your mea sure. Even if you're not hungry, just have something during the allotted time. You can always grab a piece of fruit or something small during your mealtime. Also, you don't have to eat all of the meal. You can eat just some of it. If you're not hungry, don't stuff yourself. Just eat a little. The key is to eat at regularly scheduled times so that your body grows accustomed to these eating times. Each week will change, so it's important to quickly adapt to the week that you're in and its related schedule. During the course of the week you should never go more than 4 hours without eating something. Your meals should be 3 to 4 hours apart. Your snacks should fall about 1. If you miss a meal or snack, you can't save it and eat it later or combine them. Once that time has passed, move on and hit your next mark. If you follow the recipes in the back of the book, they will fi t this description. If you buy them from a store, be sure of the calorie count. Also, be mindful of the serving sizes of the drinks. If the recipe makes more than one serving, be sure you drink only one at that time. If the store- bought product contains more than 1 serving, just drink the equivalent of 1 serving and refrigerate the rest for next time. You’re supposed to lie down immediately after drinking the olive oil and grapefruit mixture, so I get ready for bed. I know that if I don’t get ready for bed before I drink it, I probably would check email one more time (which is not a 2 minute event) and do other things that are not allowed in the protocol. Thurs. April 2. 8th – 1. PM: Almost on time. I mix 5 oz of grapefruit juice with 5 ounces of olive oil. The book says 4 ounces of each, but I figure I’m not an average sized person, so a little more won’t hurt and may even be a little more effective. April 2. 8th – 1. PM: Not tired, but. I get up again two hours later (I set an alarm) and drink the final 6 oz of Epsom salts. April 2. 9th – 1. AM: First #2. Finally, I feel like I have to use the bathroom. I grab my i. Some people only pass a few, while others pass “thousands.”I was hoping to see a bunch, but when I examined everything, I only saw 3- 5 stones floating. April 2. 9th – 1: 1. PM: Second #2. I opted to not do an enema to get everything moving. This is recommended so the “toxins” from the cleanse won’t be absorbed back into your body. Again, I understand what is being said here, but at the same time as long as there is transit (and believe me there was) the absorption would be minimal. This time, I play 4- 5 games of Sudoku and it becomes very evident to me that Epsom salts really do their job. I’m excited again to examine my flush, but find that there are only a dozen or so “stones.”Fri. April 2. 9th – 1: 4. Lunch time. I’m super hungry. April 2. 9th – 2: 5. PM: Back playing Sudoku. This round was shorter and it seems like everything is out. April 3. 0th – 8: 1. Confirmed. If you’re going to do a flush, do it on a day off. Not as bad as I thought. Based on Annmarie’s experience, I thought the liver and gallbladder flush was going to be awful. Annmarie was up all night, had pains in her stomach and was miserable the entire next day. This shows me that clearly everyone will have a different experience. I’ve heard similar things from others. Don’t exercise before you drink the salts. I knew when I was going out to exercise it wasn’t a good idea. I fought my intuition here and it beat me up. My headache wasn’t that bad, but it was a headache that I didn’t need to have. Do it again if you feel like you didn’t cleanse. I will do this again. I don’t necessarily feel that I didn’t cleanse – the feeling in my side was evidence that something was doing something – I just want to make sure I do a few rounds of this before I make any further decision about the protocol. Andreas recommends (depending on your situation) that you start with a few every month or so, then do a maintenance flush once or twice a year. I think this is reasonable. I still am not convinced that all the “stones” are stones or even all bile. Even after listening to Andreas explain the “stones” and seeing my own, I’m still not convinced that they’re all stones that have been stored in the liver and gallbladder. Based on what I’ve read – and short of sending them off for lab testing – I’m convinced that they’re a mixture of oil, citrus and bile. The good news for those that support the cleanse is regardless of what they are, there is a cleansing effect that is brought on by the excessive release of bile. Also, there MAY be real stones excreted. Did it work? This is a challenging question. Did everything happen as the book said they would? Yes. Did it transform my health? I don’t know yet. I don’t have a serious health issue that could have been helped immediately by this cleanse, so I may never know. I’ve heard many fantastic stories of gallbladder attacks ending after doing this cleanse. I’ve also heard stories of skin clearing up and other digestive issues getting better. This to me seems like at the very least some real success. As for you, it’s up to you and a trusted health practitioner to guide you through the process (if you even need it at all.)So back to my experience, I’ll be monitoring my skin and my digestion to tell you if I notice anything of note.
